Terms of Service

Welcome to Kiwiconvert (“the Service”). By accessing or using the Service, all individuals and entities (“Users”) acknowledge and accept the following Terms of Service (“Terms”). If these Terms are not agreeable, the Service should not be used.
1. Service Description
Kiwiconvert provides tools to convert images into various formats and may introduce additional functionality over time. Certain features, including premium conversions, require a paid subscription managed by Paddle. The Service does not permanently store images on Kiwiconvert’s servers. Uploaded and converted images remain within the User’s browser (via IndexedDB). RAW images are temporarily cached on the server solely for processing and deleted immediately upon completion. Kiwiconvert personnel have no access to User images, and retrieval of any images after processing is not possible. Only minimal metadata (e.g., file format, timestamps) may be retained for diagnostic or analytics purposes.
2. User Accounts
- Users may register via Google OAuth (in which case only an email address is recorded) or by providing an email and password (again, only an email address is retained).
- Users are responsible for maintaining the confidentiality of their login credentials and for any actions taken under their accounts.
3. Subscriptions and Payments
- All subscriptions are handled by Paddle, acting as the Merchant of Record, overseeing billing and applicable taxes.
- By purchasing a subscription, Users agree to abide by Paddle's payment terms. Recurring charges apply until cancellation.
- No Refund Policy: Subscriptions are non-refundable once purchased. If local laws impose specific refund requirements, Kiwiconvert will adhere to those obligations.

4. User Conduct
Users must not upload or convert content that is unlawful, harmful, infringes upon intellectual property rights, or violates any relevant regulations. Kiwiconvert reserves the right to disable or revoke access if such violations are detected.
5. Intellectual Property
Unless otherwise noted, all content provided by the Service (excluding images uploaded by Users) remains the property of Kiwiconvert or its licensors. Duplication, redistribution, or modification of this content without prior written consent is strictly prohibited.
6. Account Deletion
An account may be deleted at any time, resulting in immediate removal of personal data (including any locally stored images, to the extent feasible) from Kiwiconvert’s systems. This process is irreversible.
7. Service Availability and SLA
The Service is subject to rate-limiting quotas that vary depending on the User's subscription plan. Kiwiconvert does not guarantee 100% uptime and may experience periods of maintenance or downtime. While we strive to provide a reliable service, we are not liable for any interruptions. Users who are dissatisfied with the service may contact our support team to address their concerns.
8. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis, without any express or implied warranties. Kiwiconvert disclaims all implied warranties to the fullest extent permitted by law, including but not limited to fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, Kiwiconvert and its affiliates shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the Service, including data loss or service interruptions.
10. Changes to the Terms
Kiwiconvert may revise these Terms periodically. In the event of significant modifications, notice will be posted on the site. Continued usage of the Service after such changes are posted constitutes acceptance of the updated Terms.
